SHORT-TERM RENTAL AGREEMENT
This Short-Term Rental Agreement (“Agreement”) is made and entered into by and between Moon Landing Rentals LLC, a Florida limited liability company, with a principal address of 3970 Parkway Drive, Melbourne, FL 32934 (“Owner”), and the undersigned guest(s) (“Guest”). By executing this Agreement, Guest agrees to the terms and conditions set forth below for their stay at the property located at 3970 Parkway Drive, Melbourne, FL 32934, including the guesthouse, pool, sports courts, and other amenities (the "Property").
1. Term of Rental
The rental period shall begin at 3:00 PM on the check-in date and shall end at 11:00 AM on the check-out date, unless otherwise agreed upon by both the Owner and Guest in writing.
2. Guest Occupancy
Guest agrees to a maximum occupancy of 6 guests (adults and children) at all times during the rental period. Guest agrees not to exceed this number and acknowledges that the guesthouse is suited for a maximum of 6 people, ideally no more than 4 adults. The Guest agrees not to allow any unregistered individuals on the Property. Children (under the age of 18) are allowed, but parents/guardians are responsible for the safety of their children while on the Property.
3. Parking
Guest must park in the designated Guest Parking Area near the guesthouse. Guest agrees not to park in areas that are marked for private use or in any area where parking is prohibited. Parking is not under cover and is not on a paved surface.
4. Use of Property
(a) Shared Spaces:The Property includes shared spaces such as the tennis court, multi-sport court (pickleball, basketball, batting cage), and above-ground pool. These areas are shared with the Owner. Guests will be allowed access to these shared spaces. Tennis and sports court use is limited to 9:00 AM to dusk. Use of the pool, sports court, and recreational areas is at the guest’s own risk. No diving is allowed in the pool, and the Owner does not assume any liability for accidents or injuries associated with these amenities.
(b) Access Restrictions: Guests are prohibited from accessing any other buildings on the Property, including the Main House and Barn. Unauthorized access will result in immediate termination of the rental agreement, removal from the Property, and forfeiture of any funds.
(c) Ponds and Water Hazards: The Property contains multiple ponds. Swimming, fishing, or any interaction with the ponds is strictly prohibited. Guests are prohibited from entering or interacting with the ponds due to significant risks such as alligators, drowning, and other water-related hazards. The Owner does not assume any liability for accidents or injuries related to the ponds or any other body of water on the Property.
(d) Animal Care:Guests are not permitted to feed or handle the Owner's animals (dog and chickens). The Owner’s dog and chickens may be present on the Property, and guests are expected to respect the animals' space. Guests must not approach or attempt to interact with the animals.
(e) Security Measures: The entire Property is under video surveillance outside, primarily for security purposes. There are no cameras inside the guesthouse. The cameras are positioned in exterior areas, including the driveway, entrances, and common spaces, to ensure the safety and security of the Property. The guesthouse will be unlocked at the time of the guest's arrival, and a key will be provided so that they may lock the doors as they wish during their stay.
5. Quiet Hours
Guest agrees to observe quiet hours between 10:00 PM and 9:00 AM to ensure the enjoyment of the Property by others, including the Owner and neighbors.
6. Smoking
Smoking is strictly prohibited inside the guesthouse. Smoking is not allowed in any interior areas of the Property. A designated outdoor area may be specified by the Owner for smoking.
7. Pets
Pets are not permitted on the Property. Only the Owner’s dog and chickens are allowed on the Property, as previously stated. Guests must not interact with or feed the animals.
8. Damage to Property
Guest is responsible for any damage caused to the Property, including the guesthouse, pool, sports courts, and recreational amenities. Any damage, theft, or excessive cleaning required upon check-out will result in the forfeiture of the security deposit. If damages exceed the deposit, the Guest will be responsible for additional charges. The term "Guesthouse" refers to the separate living space on the Property, which includes all rooms and facilities rented to the Guest, as described in the listing.
9. Cancellation Policy
Cancellation of the rental must be made at least 30 days before the arrival date for a full refund. Cancellations made between 14-30 days will receive a 50% refund. Cancellations made within 14 days of the check-in date will result in no refund.
10. Security Deposit
A security deposit will be required upon booking, either via VRBO’s Damage Protection Plan or directly through the Owner. The security deposit is due in full at the time of booking and will equal the cost of one night’s rent. The security deposit will be used to cover any damages, excessive cleaning fees, or other violations of this Agreement that may arise during the rental period. If no issues are found upon inspection, the deposit will be refunded in full within 14 days of check-out.
11. Liability and Assumption of Risk
The Guest acknowledges and agrees that the use of the pool, sports courts, and other amenities is at their own risk. The Property includes multiple ponds, which pose significant risks, including potential presence of alligators and drowning hazards. Guests are prohibited from entering or interacting with the ponds. Guests assume full responsibility and risk for any accidents or injuries related to the ponds, the animals, or other dangerous areas on the Property. By signing this Agreement, the Guest waives all claims against the Owner for personal injury, property damage, or other losses that occur during their stay, including those arising from interaction with the ponds, animals, or any other dangerous areas. Guests with minor children are responsible for the safety and supervision of those children, including ensuring they do not interact with the ponds, animals, or engage in any hazardous activities. No child under the age of 18 is allowed to swim in the pool or interact with the ponds without proper adult supervision.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes shall be handled under the jurisdiction of Brevard County, Florida, and may be resolved through arbitration if necessary. The Parties agree to waive any rights to a jury trial in the event of a dispute.
13. General Provisions
(a) Amendments:This Agreement may only be amended with the written consent of both parties.
(b) Severability:If any provision of this Agreement is deemed invalid, the remaining provisions shall remain in full effect.
(c) Entire Agreement:This Agreement represents the entire understanding between the parties with respect to the rental and use of the Property.
